Triple Moon Web Hosting Services™ hereafter referred to as "Triple Moon Hosting™" provides internet World Wide Web page hosting and domain name ordering. Triple Moon Hosting has certain legal and ethical responsibilities concerning the use of its computer network and equipment involved in these services.

Triple Moon Hosting's general policy is to act as a neutral provider of access to the global Internet. Triple Moon Hosting reserves the right to suspend or cancel a customer's access to any or all services provided by Triple Moon Hosting if and when Triple Moon Hosting decides that the account has been used inappropriately.

Specific Acceptable Use Policies
1. There may not be any, xdcc, takeover, war or eggdrop bots run on Triple Moon Hosting's servers.
2. There are to be no IRCD server software installs made on any main Triple Moon Hosting server. You may only use the chat server software have provided for you in your CPanel.
3. We do not permit shoutcast/icecast servers or any type of game/mud servers, or any processes that consume a large amount of bandwidth and/or system resources to be run from Triple Moon Hosting servers.

Use of Our Servers
Web sites and services are to be used by the primary owner only. Customers are not permitted to resell or give away web hosting services from their web site to third parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Advertisements containing Spyware are strictly prohibited.

Unauthorized Use of Other People's Accounts or Computers
Triple Moon Hosting will strongly react to any use or attempted use of an internet account or computer without the owner's authorization. Such attempts include tricking other people into releasing their passwords, password cracking, security hole scanning, bandwidth theft etc... Any unauthorized use of accounts or computers by a Triple Moon Hosting customer, whether or not the attacked account or computer belongs to Triple Moon Hosting, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, according to the seriousness of the attack.

Commercial Advertisements with E-mail - Spamming
Unsolicited commercial advertisements via e-mail are prohibited, and will result in account suspension or cancellation. Commercial advertisements are unwelcome in most Usenet discussion groups and on most e-mail mailing lists. Inappropriate posting may also result in account suspension or cancellation. Spamming, or sending a message to many different off-topic newsgroups is particularly unethical and will be treated as such.

E-Mail Abuse
You may not use your web based email or pop3 accounts to harass an individual, Newsgroup, Yahoo Group, or commercial business owner. Any client caught doing so will lose their account without a refund. Once someone asks you to end contact, any further contact will be considered as harassment. You are not permitted to use our email servers to electronically send material that is not copyrighted to you, unless you have the written consent of the copyright holder.

About Unlimited Bandwidth
Triple Moon Hosting does not offer unlimited bandwidth as certain providers do. If you go over your allotted bandwidth limit, the server auto shuts down your site until a fee of $7 per Gig is paid in full. If 10 days have passed and we have not received payment, your account will be terminated until further notice.

The use of our site
All materials contained on the Triple Moon Hosting website are the copyrighted property of Triple Moon Hosting unless stated otherwise. No material from Triple Moon Hosting may be uploaded, posted, transmitted, or distributed in any way (including site graphics and text), except that you may download one copy of the materials on any single computer for your personal, noncommercial home use only, provided that (1) you keep intact all copyright and other proprietary notices, (2) you make no modifications to the materials. The use of any Triple Moon Hosting material on any other Web site or computer environment is prohibited.

Payment Policies & Billing Procedures
All accounts are set up on a pre-pay basis. Setup fees, where applicable, are charged for all new accounts and are non-refundable. Triple Moon Hosting reserves the right to change prices at any time. As of October 3, 2004 hosting prices have been adjusted in order to pay for our dedicated server. New hosting packages are paid on a month to month subscription service via PayPal. It is the clients responsibility to cancel the subscription service via PayPal should they decide to cancel hosting services with Triple Moon Hosting. All clients who joined Triple Moon hosting before October 3, 2004 are now Grandfathered and will still pay their original hosting fees based on the length of their hosting term. If 10 days have passed and payment has not been made, the account will be suspended until further notice. The customer is responsible for all money payable on the account from the time it was established to the time that the customer notifies Triple Moon Hosting to request termination of services. All payments must be made in USD funds at the current US exchange rate. All hosting packages come with a seven day money back guarantee, and are based on the date of account activation.

Late Penalty Fee's and Extra Bandwidth
Beginning February 1, 2005 there will be a $35.00 penalty fee on accounts overdue after 10 days. A bill will be sent for the late fee along with your normal hosting account fee. Accounts that are late paying their hosting fee's will be unsuspended when full payment is made. This does not apply to accounts on a subscription service where paypal is not auto sending the account fee. Extra bandwidth is $7.00 per Gig.

Upgrading Packages
You may upgrade your hosting package at any time by contacting the sales department at Triple Moon Hosting. Prices are calculated based on the price difference between your current hosting package and the hosting package you wish to upgrade to. All clients who joined Triple Moon Hosting before October 3, 2004 who wish to upgrade to one of the newer hosting packages that were added on October 3, 2004 will be required to pay for the month to month subscription service. Older clients may also upgrade to one of the older hosting packages and will pay those hosting fees based on the length of time for that hosting package. New clients joining after October 3, 2004 are not permitted to purchase the older hosting packages.

Triple Moon Hosting Package/Free Domain Name
All free domain names ordered for the Triple Moon Hosting package belong to Triple Moon Hosting. If at any time you cancel your hosting and would like to own the domain name, please contact the billing department for payment and transfer options.

Payment Methods
Payments (Visa, Master Card, Discovery, eCheck, American Express, Switch, Solo etcetera) are only accepted through PayPal.

Cancellation
Triple Moon Hosting reserves the right to cancel client services at any moment. If cancellation is due to the clients violation of these policies, no refund will be issued. Customers may also cancel their service at any time; however no refunds will be issued.

Lawful Purpose
Triple Moon Hosting reserves the right to refuse service to anyone. Customers may only use Triple Moon Hosting servers for legitimate purposes. Transmission of any material in violation of any federal, state or local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. Triple Moon Hosting specifically forbids anyone from using Triple Moon Hosting servers for propagation, distribution, housing, processing, storing, or otherwise handling in any way illegal, vulgar, or obscene materials. You may not at any time upload music files to our servers unless they are copyrighted to you. The designation of any materials such as described above is left exclusively to the discretion of Triple Moon Hosting management. Triple Moon Hosting is intended for the end user only. Clients cannot sublease, subhost, or give away control of any portion of Triple Moon Hosting resources. Doing so could result in immediate account cancellation without refund.

Indemnification
Customer agrees that it shall defend, indemnify, save and hold Triple Moon Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Triple Moon Hosting, its agents, customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Triple Moon Hosting against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Triple Moon Hostings' servers; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Triple Moon Hosting's servers.

Privacy Polices
Triple Moon Hosting collects private information from our clients with each account. It is our policy never to share your private information with any outside party that is not an owner/employee of Triple Moon Hosting. In the same regard, as a client of Triple Moon Hosting you are legally bound not to electronically transmit our information or client-to-host/host-to-client E-Mails with any outside party that is not an owner/employee of Triple Moon Hosting.

Triple Moon Hosting reserves the right to revise its policies at any time.
